Guardian Ad Litem Work

     The Preston Fox law firm specializes in guardian ad litem (“GAL”) work. Defined as a “guardian for the suit,” a GAL is an attorney who holds a special certification to advocate for clients in cases in the state of Virginia. GALs are either appointed for children or incapacitated persons. Judges will appoint a GAL as required by law to aid the court in making rulings in cases before the bench.

 

    The major distinction between an attorney representing a client and an attorney/GAL appointed to advocate for a client is that the GAL must assert the client’s best interests instead of merely fighting for what the client desires. At times, those interests are at odds or are simply different. A common example of this is an abused child wanting to be reunited with the parents, even when there is a high risk of the parents further harming the child. It is the GAL’s duty to advocate for the child’s safety by taking measures to protect the child’s safety such as asking the judge to order supervised visitation. 

 

    The GAL is also charged with conducting an independent investigation in each case and making recommendations to the court based on the findings. Cooperation from the parents during the GAL’s investigation is essential. All questionnaires and background check forms should be completed thoroughly and promptly. Active participation in interviews and home visits are also essential.

 

    Barring an agreement of the parties, the judge will preside over a trial and make a decision based on the evidence before the court. However, judges carefully consider the GAL’s report and recommendations. Accordingly, having an experienced and dedicated GAL is extremely important.
